BARKER HOUSE CONSTITUTION

PREAMBLE

We the residents of Barker House, having been thrust together by the Department of Residence, in order to provide a safe, substance-free environment, promote the general welfare, provide for the common defense, uphold the traditions and honor of Barker House, do ordain and establish this constitution.

ARTICLE I Name and Membership

The name of this membership shall be Barker House. Any Iowa State students residing on the first or second floors of Lyon Hall for any semester or part thereof shall be a member of Barker House and shall be bound by all sections of this constitution.

ARTICLE II The Executive Body

The executive body shall be called the House Cabinet. It shall be directly accountable to the members of Barker House. It shall consist of the following positions: President, Vice-President, Secretary, Treasurer, Social Chairpersons, New Person Representative, Educational-Cultural Chairperson, Intramural Chairpersons, Barton-Lyon-Freeman-Fisher/Nickel Representative(s), Environmental Chairperson, Historian, and Webmaster. The Resident Assistant shall serve as an advisor for the executive body.

ARTICLE III The Legislative Body

The legislative body shall consist of all house members at a house meeting except where otherwise specified by this constitution or university policies.

ARTICLE IV Secret Ballot Voting

All secret ballot voting shall be conducted by the Historian. Secret ballot voting shall be used for the normal election of members of cabinet. Secret ballot voting shall also be used for voting on the mandatory budget, social budget, and constitutional amendments.

ARTICLE V Amendments to the Constitution

Amendments may be made to this constitution and bylaws when approved by 2/3 of the house in an election. Amendments to this constitution shall be offered to the members of the house whenever the House Cabinet feels it necessary or whenever it is so required by a petition of 1/4 of the house members. Copies of all approved amendments shall be posted in the house at least five days prior to voting and shall be read at one house meeting prior to voting.

ARTICLE VI Ratification

This constitution and bylaws shall be declared in effect when it is ratified, by secret ballot, every fall semester, by 2/3 of the house members. The proposed constitution must be announced at a house meeting and posted at least five days prior to voting. The secret voting process is to be supervised by the Historian.

BYLAWS FOR BARKER HOUSE

PURPOSE OF BARKER HOUSE

The purpose of Barker House is to provide a safe living environment for Iowa State Students who want to have fun while maintaining their studies.

1: HOUSE MEETINGS

1:A House meetings shall be scheduled by the cabinet to meet the needs of the house.

1:B Special house meetings shall be called by the president as needed. House members may initiate a special meeting by presenting to the president a petition with the signatures of at least 1/4 of the house members.

1:C In all cases where the Constitution and the bylaws are found to be insufficient, Robert's Rules of Order shall be observed.

2: HOUSE CABINET

2:A The House President shall serve as the Chairperson of the House Cabinet. In the case of a tie in the House Cabinet, the issue shall be taken to the next house meeting. All members of the House Cabinet, as defined in Article II of the Barker House Constitution, are expected to attend all meetings and may be excused from two meetings before dismissal is considered by the House Cabinet unless the absence(s) are approved by 2/3 of the House Cabinet. A quorum of 2/3 of the House Cabinet must be present in order to conduct any business.

2:B House Cabinet meetings shall be called by the President. Decisions of the House Cabinet may be revoked by a majority vote of the house members present at the next meeting. All decisions of the House Cabinet are to be reported at the next House Meeting.

2:C The duties of the House Cabinet shall be the following:

  1. The presentation of all policies and rules for the welfare of house members and execution of house business.
  2. The House Cabinet shall make a recommendation to the house of all expenditures over $15.00 that are not included in the budget. This requires a simple majority.
  3. The approval of all appointments by the President.

3: EXECUTIVE OFFICERS

3:A The President of Barker House shall:

  1. Preside at all house meetings and House Cabinet meetings.
  2. Appoint all committees that may become necessary for the transaction of house business with the approval of the House Cabinet and act ex-officio as a member of each committee.
  3. Be responsible each semester for organizing the cleaning and packing of the storage closet.
  4. Hold the power to appoint House Cabinet members in the event of a vacancy of a House Cabinet position outlined in Article II of the Barker House Constitution.
  5. Hold the power to delegate duties as deemed necessary by the President
  6. Be responsible for providing general welfare, upholding the traditions and honor of Barker House, and execution of all house policies and procedures.
  7. Have the power to approve, with the consent of the Treasurer , non-budget expenditures under $15.00
  8. Attend and participate in BLFF/N Hall Council meetings as defined in the BLFF/N Hall Constitution.
3:B The Vice-President shall:
  1. Possess executive power during the temporary absence or inability of the President
  2. Attend and participate in BLFF/N Hall Council meetings during the absence or inability of the President.
  3. Become President in the event of permanent absence of the President
  4. Attend and participate in BLFF/N Programming Council meetings as defined in the BLFF/N Hall Constitution.
3:C The Secretary shall:
  1. Record all minutes of house meetings and post them within 48 hours and keep a file of such records. The minutes shall remain posted until the next house meeting.
  2. Organize and distribute summer mailing addresses each spring semester.
  3. Organize and distribute the Barker Residence phone and email list.
  4. Shall pass out a form for the nice awards at each house meeting. These shall be typed and posted within 48 hours of the house meeting in accordance with Standing Order 1.
  5. Shall organize and distribute an escort list each semester.
3:D The Treasurer shall:
  1. Make a budget at the beginning of each semester and present it to the members of the House Cabinet and house members for approval
  2. Collect semester dues which will be paid by each house member, the amount to be determined by the Executive Council of the RCA and by the House Cabinet
  3. Record all funds, receipts, expenditures, and report the balance of the account to the House Cabinet when it meets and at house meetings.
  4. Produce a receipt for all expenditures and disperse all money vouchers.
  5. Report any authorized, non-budgeted expenditures at the cabinet and house meetings
  6. Present books and files to the University Auditor at the end of each academic year.
3:E The Social Chairperson(s) shall:
  1. Plan and carryout social programs for the house which will follow University rules and regulations with the University, RCA social programs and the desires of the members of Barker House. These events may include, but are not limited to, the following:
    1. Watermelon Meet-And-Greet (beginning of fall semester)
    2. Labor Day Picnic
    3. Halloween Party
    4. Secret Santa Party
    5. Dinner exchanges (one each semester)
    6. Harwood-Barker Football Game (one each semester)
    7. Dead Week Treats (both fall and spring semester)
    8. Super Bowl Party
  2. Call and moderate women's/men's meetings as deemed necessary by the house.
  3. Take charge of all house correspondence.
  4. Maintain house moral.
3:F The Educational-Cultural Chairperson shall:
  1. Act as house representative and cultural connection to the ISU Center and other cultural activities and groups.
  2. Plan and promote educational-cultural programs.
  3. Act as community service chairperson.
  4. Be responsible for recognizing high scholastic achievement.
  5. To organize the house picture that is taken every fall and hang it up in the parlor.
3:G The Intramural Chairperson(s) shall:
  1. Be responsible for informing the house members of all campus intramural activities and promoting house participation in these activities.
  2. Serve as representative(s) to the campus intramural committee.
  3. Sign-up all house teams for intramural events.
3:H The New Person Representative shall:
  1. Be new student to Barker House in the academic year in which they are elected.
  2. Be elected by only new students to Barker House. This election is to be held in the Fall of each academic year. The term will last for one academic year.
  3. Serve as the communication channel between the House Cabinet and the new students on Barker House.
  4. Keep and maintain the vacuum cleaner.
  5. Organize and head the Big Sibling/Little Sibling program.
3:I The Barton-Lyon-Freeman-Fisher/Nickel (BLFF/N) Representative(s) shall:
  1. Serve as house representative(s) to the BLFF/N Programming Council.
  2. Be responsible for informing the house members of BLFF/N activities.
  3. Be elected in accordance with the BLFF/N Committee by Barker House members.
3:J The Environmental Chairperson shall:
  1. Be in charge of organizing the recycling area on Barker House.
  2. Arrange for the removal of recyclable materials from Barker House.
  3. Promote recycling and environmental activities on Barker House.
  4. Shall organize a "Clean the Creek" event each semester.
3:K The Historian shall:
  1. Keep and maintain the Barker File. The Barker File is defined as the record of all Barker House activities and memorabilia including but not limited to roommate pictures, House Pictures, scrapbooks, journals, and notes of house activities.
  2. Update the Barker File regularly by keeping notes and pictures of house events.
  3. Be responsible for all secret ballot voting in accordance with this Barker House Constitution and RCA Regulations.
  4. Be responsible for obtaining house shirts each semester.
  5. Be responsible for taking roommate pictures each semester.
  6. Responsible for all elections of House Cabinet members throughout their term.
3:L The Webmaster shall:
  1. Maintain and update the Barker House Web Page
  2. Post minutes and news of House events
  3. Update Phone List and Alumni List
  4. Maintain Barker House activity pages (KQ, Lawnchair, etc.)
  5. Maintain Barker House email lists.

4: ELECTIONS

4:A The president, vice president, and treasure of Barker House must have lived as an official member of the house at least one semester prior to taking office. All cabinet members must have a 2.00 cumulative grade point average or better. The cabinet members must plan to reside in Barker House for their full term of office.

4:B All House Cabinet members' terms shall end on December 31. Elections shall be held at the end of the fall semester as designated by the house Historian in order fill each position outlined in Article II of the Barker House Constitution. The new House Cabinet members shall take office on January 1.

4:C Nomination Process for Executive Positions:

  1. The nomination process shall be presided over by the house Historian.
  2. The Historian shall be responsible for supplying information about the responsibilities of executive officers and the requirements that perspective candidates must meet in order to be placed on the ballot.
  3. Nominations shall begin at the House Meeting which precedes the election by at least 5 days
4:D Campaigning:
  1. No campaigning will be allowed at the election place.
  2. All regulations governing the campaigning process must be approved by a 2/3 majority of the house.
  3. The Historian shall enforce all campaigning regulations.
4:E Election Process:
  1. The House Cabinet shall regulate the voting procedure, excluding the tabulation process within the rules stated by the Constitution and the bylaws. The Historian shall enforce those procedures.
  2. Ballots shall be tabulated by the Historian and Resident Assistant in private.
  3. Ballots are to be kept for one week incase a recount is requested by any member of the house. In the event of a recount, the Historian, the Resident Assistant and a representative of the individual requesting the recount will perform the recount.
  4. Results of an election:
    1. The outcome of the elections shall be posted immediately.
    2. All candidates, upon request, shall be told their individual results in the election in private.
    3. In the case of two candidates for any office, the winner must be a simple majority.
    4. In the case of three or more candidates for any single office, the winner must defeat his/her closest competitor by 10% of the votes cast.
    5. In the case of an office with multiple positions, the candidates with the most votes are declared the winners.
    6. If the conditions of part d) or e) are not met, then the person receiving the fewest votes will be removed from the ballot and a new vote taken. Repeat this process until the conditions are met, then, the individual with the most votes is the winner.
  5. Voting for house t-shirts and house paintings have to be approved by 50% or a simple majority of the house.  25% of the house members must be present at the house meeting.
  6. In order to vote to revote on any house issue, 50% of those people in attendance at the house meeting must vote yes for the revote.  25% of the house members must be present at the house meeting.

5: IMPEACHMENT OF EXECUTIVE OFFICERS

5:A Impeachment of an executive officer may be initiated by petition of 1/2 of the members of the house or a 2/3 vote of cabinet.

5:B A house meeting shall be called one week after the initiation of impeachment proceedings. At this time the officer in question may present his/her defense to the house. A secret ballot shall be made. A vote of 80% of all those living in Barker House is required for removal from office.

6: FINANCE

6:A Proposal and Approval:

  1. Dues shall be proposed by the House Cabinet each semester.
  2. They must be announced at a house meeting and posted at least 5 days prior to voting.
  3. Mandatory house dues must be approved by an 80% majority of the house members
  4. Voluntary (social) dues must be approved by a simple majority of house members
  5. Voting procedures will be same as those for the election of officers except as indicated in this section.
6:B Collection of dues is the responsibility of the house treasurer.

6:C Dues paid to Barker House shall include RCA dues and BLFF/N dues as set by the RCA Senate and BLFF/N Programming Board, and the house dues as set by the cabinet and ratified by the house.

6:D Non-budgeted expenditures:

  1. Non-budgeted expenditures between $15.00 and $50.00 can be approved by 2/3 of the cabinet.
  2. Expenditures greater than $50.00 must be approved by 2/3 of the all house members.

2: TRADITIONS

The following are some of the Barker House traditions. It is the honor and duty of house members to uphold these traditions as sacred. If for any reason knowledge of these events is lost all prudent measures must be taken to restore them to their proper place in Barker House.

3: BLOOPER

A blooper is a dumb or humorous thing that a member of the house has done in the past. A resident can be nominated by anyone present at a house meeting. All the nominations are then to be read to the house after being given a humorous title. The house then votes by applause for the best blooper. The "Calibrator" determines who wins. The winner then must redeem themself to the floor the next week by performing a redemption. The redemption is an entertaining thing that could be a skit, lip sync, joke, activity, poem, story etc.  If a redemption is sub-standard or does not meet the house's approval, a motion can be made to prank the individual in question.  A simple majority vote rules.  This prank must be carried out before the next house meeting.  

The winner is also responsible for the cleaning of the den microwave for the week preceding the redemption performance.  

4: Nice Awards

A nice award can be given by any member of Barker House to anyone for any reason. The intent is to provide a means to thank people for their nice deeds. This list shall be censored by the secretary to ensure it is in good taste and meets the intended purpose of the Nice Award.
